IMPORTANT NOTICE: ADULT ONLY (18+) GAME
By creating an account, accessing the game, or using our services, you solemnly declare, warrant, and represent that you are at least 18 years of age (or the legal age of majority in your jurisdiction, whichever is higher) and have the legal capacity to enter into this agreement.
If you are under 18 years of age, or if you are offended by explicit adult content, dialogue, and themes, you are strictly prohibited from accessing or playing Scarlet Chains. Leave this website immediately.
1. The Operator
Scarlet Chains (the "Service" or the "game") is operated by ScarletGames, a ScarletGames with its registered address at HIDDEN ("we", "us", "our", or "Scarlet Chains"). These Terms of Service form a binding agreement between you and the Operator.
Our Privacy Policy explains how we collect and use personal data. It is incorporated into these Terms by reference; by using the Service you also acknowledge the Privacy Policy.
2. Description of Service
Scarlet Chains is an online, multi-player, mature gaslamp fantasy role-playing game (RPG) and simulation. The game involves:
- Explicit, raw adult interactions, texts, and dialogue.
- Themes of consensual power exchange, dominance, submission, and training of household companions.
- Base building, manor management, and recruiting specialists.
- A player-driven market ("Flesh Market") for contract trading and resource management.
3. Age, Content, Access, and Eligibility
By accessing Scarlet Chains, you acknowledge and agree that:
- Player Age Verification: You are at least 18 years old. Underage access is a material breach of these terms, resulting in immediate account termination.
- Adult Content Confirmation: The service contains highly explicit texts, dialogue, themes, and depictions of sexual behavior.
- All Characters Are Adults: All non-player characters (NPCs), companions, specialists, servants, and other virtual personas depicted in the game are fictional, and are designed and represented exclusively as adults (18+ years of age). Any depiction of training, service, or submission is strictly within the context of consensual adult fantasy roleplay.
- Theme Warning: The game features mature themes including BDSM, bondage, dominance, submission, and raw adult language. If such themes cause you distress or offense, you should not play.
- Private Access Obligation: You agree to access the game only in a private setting. You are solely responsible for ensuring that the explicit content of the game is not viewed or accessed by minors or individuals who may find it offensive.
- Entry Confirmation: The public home page may ask you to confirm adult status before sending you to the game app. That confirmation is not a substitute for your legal obligation to be an adult.
- Local Legality: You are solely responsible for ensuring that accessing adult content of this nature is lawful in the jurisdiction from which you access the Service. If accessing such content is illegal where you are located, you must not use the Service.
- Sanctions and Export Restrictions: You may not use the Service if you are located in a country or territory subject to comprehensive sanctions, or if you are a person on any applicable government restricted-party list.
4. Account Creation and Security
- Account Registration: You must provide accurate and complete registration information (e.g., a valid email address).
- Account Access Security: You are solely responsible for safeguarding access to your account email and one-time login codes. You must notify us immediately of any unauthorized access.
- Single Account Policy: Players are permitted one active account. Account sharing or transferring accounts to other individuals is prohibited.
5. Payments, Billing, and Virtual Items
Scarlet Chains may offer virtual items, bonuses, in-game currency, or access to special storylines/quests for purchase ("Paid Features").
- Purchases: All payments are made in real-world currency through our authorized third-party payment processors. You agree to pay all fees and applicable taxes incurred by you or anyone using your account.
- Virtual Item License: When you purchase virtual items, currencies, or quests, you are buying a limited, personal, non-transferable, revocable license to use those features within the game. You do not own the virtual items or quests.
- Payments are Final (No Refunds): All purchases of virtual items, in-game currency, or quest unlocks are final and non-refundable, except as required by applicable law or as determined in our sole discretion.
- EEA/UK Right of Withdrawal: If you are a consumer in the European Economic Area or the United Kingdom, you have a statutory 14-day right to withdraw from purchases of digital content. By purchasing a Paid Feature, you expressly request immediate delivery of the digital content and acknowledge that you thereby lose your right of withdrawal once delivery has begun. This does not affect refund rights that mandatory law grants for faulty or misdescribed digital content.
- Price Modifications: We reserve the right to change the pricing, availability, and specifications of virtual items, quests, and services at any time without notice.
6. Virtual Economy and the Player Market
- Virtual Items: All virtual items, characters, contracts, manor upgrades, and currencies (in-game coins/credits) are virtual property and have no real-world monetary value.
- No Cash Value: Virtual assets cannot be redeemed for cash, real-world goods, or services.
- Market Rules: The in-game market is simulated and player-driven. We make no guarantees regarding market stability, asset valuation, or availability.
- RMT Prohibition: Real-Money Trading (RMT), meaning the buying, selling, or trading of in-game accounts, items, characters, or contracts for real-world currency or goods outside of authorized game systems, is strictly prohibited and will result in a permanent ban.
7. Code of Conduct and User Content
When interacting with other players, using public chat systems, naming characters, or participating in the community, you agree NOT to:
- Impersonate any other person, administrator, or staff member.
- Share real-world personal identifying information (doxxing) of other players.
- Use automated bots, scripts, cheats, hacks, or exploits.
- Upload, transmit, or input any content that is illegal, non-consensual, or depicts real-world harm.
- Create usernames, guild names, or public profile text containing hate speech or references to real-world harm.
License to User Content: You retain ownership of the content you create in or submit to the game (such as usernames, character names, profile text, and chat messages) ("User Content"). By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, display, and distribute that User Content for the purpose of operating, promoting, and improving the Service. This license ends when your User Content is deleted from our systems, except where retention is required by law or the content has already been shared with other players.
Moderation: We may, but are not obligated to, monitor User Content. We reserve the right to remove, edit, or refuse any User Content, and to restrict any account, at our sole discretion, with or without notice, including for violations of this Code of Conduct.
8. Intellectual Property and DMCA Policy
- Game Assets: All text, dialogue, artwork, music, code, icons, character profiles, and designs are the exclusive property of the Scarlet Chains development team and its licensors.
- License: We grant you a limited, non-exclusive, non-transferable, revocable license to access and play the game for personal, non-commercial entertainment.
- DMCA / Copyright Complaints: If you believe that any content in the game or uploaded by users infringes your copyright, submit a takedown notice through Support until a dedicated DMCA contact is published.
Your notice should include a signature of the copyright owner or authorized representative, identification of the copyrighted work, identification of the allegedly infringing material, your contact details, a good-faith statement, and a statement under penalty of perjury that the information is accurate.
Counter-Notice: If your content was removed following a takedown notice and you believe the removal was a mistake or misidentification, you may submit a counter-notice through the same channel. A counter-notice must include: your physical or electronic signature; identification of the removed material and its former location; a statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification; your name, address, and telephone number; and a statement that you consent to the jurisdiction of the federal district court for your address (or, if outside the United States, the District of Delaware) and will accept service of process from the original complainant. Unless the complainant notifies us within 10 business days that they have filed a court action, we may restore the removed material.
Repeat Infringers: We will terminate, in appropriate circumstances, the accounts of users who are repeat copyright infringers.
9. Feedback
If you submit suggestions, ideas, or feedback about the game, you agree that we may use them without restriction or compensation to you, and you grant us a perpetual, irrevocable, worldwide, royalty-free license to use and incorporate them into the Service.
10. Service Changes and Alpha Status
Scarlet Chains is in Alpha.
The game is under active development. Features, content, balance, virtual items, and the in-game economy may change substantially or be removed at any time. Accounts, characters, progress, virtual items, and in-game currency may be reset, wiped, or lost during development, including without notice. Paid Features are licensed for use in the game as it exists from time to time; we do not guarantee that any feature, item, or storyline will remain available.
We reserve the right to modify, suspend, or discontinue the Service, in whole or in part, at any time. Where reasonably practicable, we will give advance notice of a permanent shutdown of the game, but we are not obligated to provide compensation for discontinued features or services except where required by applicable law.
11. Indemnification
You agree to defend, indemnify, and hold harmless the Scarlet Chains development team, its operators, affiliates, and contributors from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms of Service or your use of the game.
12. Disclaimers and Limitation of Liability
The game and all services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind. To the maximum extent permitted by law, the Scarlet Chains development team shall not be liable for any indirect, incidental, special, or consequential damages arising out of your access or inability to access the game.
Liability Cap: To the maximum extent permitted by law, our total aggregate liability to you for all claims arising out of or relating to the Service or these Terms shall not exceed the greater of (a) one hundred US dollars (USD $100) or (b) the total amount you paid us in the twelve (12) months preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for death or personal injury caused by negligence, or for fraud.
13. Consumers in the EEA and United Kingdom
If you are a consumer habitually resident in the European Economic Area or the United Kingdom, nothing in these Terms affects your mandatory statutory rights, including rights relating to digital content conformity and remedies. Where these Terms conflict with mandatory consumer protection law of your country of residence, that law prevails. You may also be entitled to bring proceedings in the courts of your country of residence, and the arbitration provisions in Section 15 apply to you only to the extent permitted by the law of that country.
14. Governing Law and Jurisdiction
These Terms of Service and any disputes arising out of or related to them shall be governed by and construed in accordance with the laws of Delaware, United States, without regard to its conflict of law principles, subject to any mandatory consumer protections described in Section 13.
15. Dispute Resolution and Binding Arbitration
Please read this section carefully. It affects your rights, including your right to file a lawsuit in court and your right to a trial by jury.
All disputes, claims, or controversies shall be resolved exclusively through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. YOU AND SCARLET CHAINS AGREE THAT ANY ARBITRATION OR COURT PROCEEDING SHALL BE CONDUCTED INDIVIDUALLY AND NOT AS A CLASS, REPRESENTATIVE, OR CONSOLIDATED ACTION, AND YOU AND SCARLET CHAINS EACH WAIVE ANY RIGHT TO A TRIAL BY JURY.
- Informal Resolution First: Before initiating arbitration, contact us through Support and make a good-faith effort to resolve the issue informally for at least 30 days.
- Small Claims Carve-Out: Either party may instead bring an individual claim in small claims court if the claim qualifies.
- Injunctive Relief Carve-Out: Either party may seek injunctive or other equitable relief in court to protect its intellectual property rights or to stop unauthorized access to or abuse of the Service.
- 30-Day Opt-Out: You may opt out of this arbitration agreement by notifying us through Support within 30 days of first accepting these Terms, stating your account username and your clear intent to opt out of arbitration. Opting out of arbitration does not affect any other provision of these Terms.
- Severability of Class Waiver: If the class action waiver is found unenforceable as to a particular claim, that claim (and only that claim) shall proceed in court, and the waiver shall remain in effect for all other claims.
16. Suspension and Termination of Service
We reserve the right, in our sole discretion, to suspend, terminate, or restrict your account and access to the game at any time, with or without notice, for any violation of these Terms of Service, including in particular:
- Unfair Play: Cheating, exploiting bugs or unintended game mechanics, abusing glitches for gain, or otherwise gaining an unfair advantage over other players.
- Automation: Using bots, scripts, macros, or any automated means to play the game or interact with the Service.
- Economy Abuse: Market manipulation, collusion between accounts, multi-accounting, or Real-Money Trading as described in Section 6.
- Conduct Violations: Any breach of the Code of Conduct in Section 7, including harassment, doxxing, or impersonation.
- Fraud and Security: Payment fraud, chargebacks made in bad faith, unauthorized access attempts, or interference with the operation or security of the Service.
- Age or Eligibility Breach: Being under 18 or otherwise ineligible under Section 3.
Remedies: Depending on the severity of the violation, we may issue a warning, temporarily suspend the account, remove or roll back items, currency, progress, or market transactions obtained through the violation (including from accounts that knowingly benefited from it), or permanently terminate the account. Severe violations (such as cheating, botting, RMT, or underage access) may result in immediate permanent termination without prior warning.
Appeals: If you believe your account was restricted in error, you may appeal through Support within 30 days of the action.
- Termination by You: You may stop using the Service at any time and may request deletion of your account through Support (see the Privacy Policy for how account data is handled).
- Effect of Termination: Upon termination or deletion of your account for any reason, your license to the game and to all virtual items, currencies, and Paid Features ends, and any remaining virtual items or in-game currency are forfeited without refund, except where a refund is required by applicable law or where termination resulted from our uncured material breach.
- Survival: Sections that by their nature should survive termination (including intellectual property, indemnification, disclaimers, limitation of liability, dispute resolution, and general provisions) survive termination of these Terms.
17. Changes to Terms
We may update these Terms of Service from time to time. For material changes, we will provide reasonable advance notice, such as a notice on the website or upon login, before the changes take effect. Your continued use of the game after updates take effect constitutes acceptance of the modified terms. If you do not agree to the modified terms, you must stop using the Service.
18. General Provisions
- Severability: If any provision of these Terms is held invalid or unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions remain in full force and effect.
- Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the Service and supersede any prior agreements.
- No Waiver: Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
- Assignment: You may not assign or transfer these Terms or your account. We may assign these Terms in connection with a merger, acquisition, sale of assets, or by operation of law.
- Force Majeure: We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including outages of third-party infrastructure, natural disasters, war, or government action.
19. 18 U.S.C. §2257 Exemption Statement
All content in Scarlet Chains is fictional. The game consists of written text, dialogue, and artistically rendered fictional characters. It does not contain any visual depictions of actual human beings engaged in actual or simulated sexually explicit conduct. Accordingly, the record-keeping requirements of 18 U.S.C. §2257 and 28 C.F.R. Part 75 do not apply to this Service.
